Our Collection Process


J.J. Marshall's goal is to work with debtors without making them defensive. That results in a more positive response and collecting more of the debt. Most debtors really do want to pay their bills, even if it's a low priority, or current circumstances make it difficult. Collecting debt is usually a multi-step process. To collect, you must communicate. Direct contact by a third party collector usually has greater impact than contact by the creditor.

We have broken our communication process down into 5 phases:

 

PHASE I The debtor is notified by mail that their account has been sent to J.J. Marshall for collection. All letters sent to debtors must contain language approved and required within federal guidelines. This leaves little room for personal messages. Also, letters are easy to ignore. A small percentage of recoveries are made in this phase.

PHASE II Additional letters are sent and attempts are made to contact the debtor by phone. Debtors are sophisticated today and can hide behind technology. At this stage, some form of investigation may begin. Various resources are used to expose the information we desire. Well placed phone calls and sound judgement reveal the collectibility of an account.

PHASE III The debtor has been skiptraced and found. We present the facts a debt is owed based on the information provided by our client. At this stage we will identify how collectible the debt is. Many times the debtor will pay voluntarily if we can explain the situation. We attempt to accommodate the debtor, in an effort to resolve the situation. Several payment options are available to make it convenient for the debtor to pay. Furthermore, if payment is not made, it could adversely effect their credit rating and further collection action may become necessary.

PHASE IV If the debtor still hasn't paid, we may suggest to our client that legal action may be necessary to recover the debt. We have, in the meantime, verified assets, employment, addresses, and the probability of recovery. In the event of a lawsuit, a summons is hand delivered by a court officer, which can also have an impact on the debtor. In most circumstances, this may result in payment in full or arrangements for payment. At this stage the debtor realizes you are serious about recovering your debt.

PHASE V Judgement entered. A judgement made in favor of the creditor doesn't mean the creditor automatically collects. Payment must still be pursued. A post-judgement collection may include writs of garnishing wages and a writ of execution for the debtor's personal property. Almost half of the dollars J.J. Marshall returns are the result of a post-judgement recovery.
